These Terms of Service ("Terms") govern your subscription, activation, and use of FlashNet internet, television, and related telecommunications services provided by Swift Network Technologies Ltd. ("FlashNet", "we", "us", "our"). By using or subscribing to our services, you explicitly agree to be bound by these Terms.
1. Services and Pricing Adjustments
FlashNet provides high-speed internet access, television, and related services on a "best-effort" basis. Service availability, delivered speeds, and network performance are subject to change based on geographic location and third-party underlying network conditions. All services are strictly subject to our Acceptable Use Policy (AUP).
Price Adjustment Notice (CRTC Compliant): FlashNet reserves the right to adjust its recurring monthly package rates and service fees at its sole discretion. For month-to-month subscribers, we will provide at least thirty (30) days' prior written notice via email before any rate change takes effect. Continued use of the service after the effective date specified in the notice constitutes explicit acceptance of the updated monthly pricing.
2. Account, Billing, and Payment
You must provide accurate, current, and complete information when creating an account. You are solely responsible for all authorized or unauthorized charges incurred under your account.
- Service fees are billed monthly in advance.
- Pre-authorized credit card payments will be automatically processed on your recurring monthly billing date via our payment infrastructure.
- For customers paying via e-Transfer, payment must be successfully cleared by the billing due date to avoid immediate service restriction or suspension.
- A late fee of 2% per month will apply to all overdue balances. We reserve the right to suspend or terminate accounts with overdue balances without further notice.
3. Equipment Rental
FlashNet provides customer premise equipment ("Equipment") to subscribers under a Device Rental Plan. The Equipment remains the sole and exclusive property of Swift Network Technologies Ltd. at all times.
3.1 Monthly Rental Fee
- Customers agree to pay a monthly Equipment Rental Fee (as specified in your plan) for the duration of their active service.
- The rental fee is separate from and in addition to your monthly service fee.
- The rental fee is not a purchase installment and does not transfer ownership of the Equipment to the customer at any time.
3.2 Equipment Return Upon Service Termination
- Upon cancellation or termination of service for any reason, the customer is strictly required to return all Equipment in good working condition (normal wear and tear excepted) within 14 calendar days.
- Return shipping costs are the responsibility of the customer.
- FlashNet may provide a prepaid return label upon request. If a prepaid label is provided, the cost will be deducted from any refund due or charged to the customer's payment method.
3.3 Non-Return of Equipment
- If the Equipment is not returned within the 14-day return window, or is returned in a damaged condition beyond normal wear and tear, FlashNet will charge the customer's payment method a Equipment Non-Return Fee of $200.00 CAD per device.
- This fee represents the replacement cost of the Equipment and is not a penalty or early termination fee. It is compensation for FlashNet's property that was not returned.
- For customers without a credit card on file (e.g., e-Transfer users), unreturned Equipment balances will be forwarded to a third-party collection agency, which may report the outstanding debt to major credit bureaus (Equifax and TransUnion).
4. Service Term, Activation, and Cancellation Policy
4.1 Service Term (Fixed Price Guarantee)
- 2-year plans include a price lock guarantee — your monthly service rate will not increase for 24 months. The Equipment Rental Fee is also locked for the same period.
4.2 Service Cancellation (30-Day Notice)
- Customers may cancel their service at any time by providing 30 days' prior written notice to FlashNet.
- Written notice may be submitted via email to support@swiftnetworktech.com or through our customer portal.
- The cancellation will take effect on the date specified in the notice, which must be at least 30 days from the date the notice is received.
- The customer remains responsible for all monthly service fees and Equipment Rental Fees until the effective cancellation date.
- There is NO early termination fee or penalty for cancelling service before the end of the 2-year period. The only obligation upon cancellation is to return the rented Equipment as described in Section 3.2.
⚠️ Important Notice: FlashNet does NOT charge early termination fees (ETFs) or any other penalties for cancelling your service early. The only amounts you may owe upon cancellation are:
- Unpaid service fees up to the cancellation date
- Unpaid Equipment Rental Fees up to the cancellation date
- $200.00 CAD Equipment Non-Return Fee only if you fail to return the Equipment
This is fully compliant with CRTC's Telecom Regulatory Policy CRTC 2026-43, which prohibits early termination fees.
4.3 Order Activation and Pre-Installation Serviceability
- A) Order Disqualification by FlashNet: If an order is cancelled by FlashNet prior to installation because the target address is determined to be technically unserviceable by our underlying infrastructure network, a 100% full refund of all charged or pre-authorized amounts will be issued immediately. The customer will bear zero financial obligations.
- B) Pre-Installation Cancellation by Customer: If the customer requests to cancel the order for personal reasons after payment/pre-authorization has been processed, the first month's prepaid service fee and shipping fee are non-refundable to compensate for non-recoverable merchant transaction fees and system provisioning costs.
5. Equipment Deposit (Optional, if applicable)
In certain cases, FlashNet may require a refundable Equipment Deposit at the time of service activation.
- The deposit is held as security for the Equipment and will be fully refunded when the customer returns the Equipment in good working condition upon service termination.
- The deposit cannot be withheld as a penalty for early service termination. It may only be applied against:
- Unpaid Equipment Rental Fees, or
- Equipment Non-Return Fee (as per Section 3.3), or
- Outstanding unpaid service fees.
- If the deposit exceeds any outstanding amounts, the difference will be refunded to the customer.
6. Limitations of Liability & Third-Party Infrastructure
FlashNet delivers services utilizing underlying third-party telecommunications carrier infrastructure. Swift Network Technologies Ltd. shall not be held liable or financially responsible for any temporary service interruptions, latency drops, line drops, or scheduling delays caused by upstream carrier maintenance, localized fiber cuts, severe weather conditions, or local carrier outages.
Under no circumstances shall Swift Network Technologies Ltd. be liable for any indirect, incidental, or consequential damages (including, but not limited to, loss of business profits, data loss, or remote employment disruptions) arising out of the use or inability to use our services. Our maximum aggregate liability is strictly limited to the cumulative amount paid by you to FlashNet in the preceding one (1) month.
7. Service Calls and Diagnostic Charges
FlashNet provides troubleshooting and technical support on a "best-effort" basis. If a service call, technician dispatch, or diagnostic visit is required to address a reported service issue, and the issue is ultimately determined to be not caused by FlashNet's network, equipment, or upstream carrier infrastructure, the customer shall be responsible for all associated charges incurred by FlashNet.
- Examples of customer-caused issues include, but are not limited to:
- Customer premise internal wiring or cabling issues (e.g., damaged or improperly connected Ethernet or coaxial cables)
- Customer-owned equipment malfunctions (e.g., routers, computers, or network devices not supplied by FlashNet)
- Software configuration issues, viruses, malware, or user error
- Issues caused by third-party services or devices not provided by FlashNet
- Damage to wall-mounted network boxes or equipment caused by the customer or end user
- Service calls requested by the customer where no fault is found with FlashNet's or the upstream carrier's network
- If FlashNet or its upstream carrier is required to dispatch a technician to the customer's premises, and the technician determines that the issue is not related to FlashNet's or the carrier's network, the customer will be charged the full cost of the dispatch, including any related fees charged to FlashNet by the upstream carrier.
- Diagnostic tests conducted by the upstream carrier that return a result of "Test OK" or "Found OK," or any tests where the issue is determined to be outside the carrier's network, may result in diagnostic charges that will be passed through to the customer.
- All such charges will be clearly identified on the customer's invoice and are due within the standard payment terms.
8. Governing Law
These Terms and your contractual relationship with us are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any legal dispute shall be handled within the jurisdiction of BC courts.
9. Changes to Terms
We reserve the right to modify or replace these Terms from time to time. Continued use of FlashNet services or maintaining an active order after updates are posted to our website constitutes your explicit and binding acceptance of the revised Terms.
